The service
Aqeris provides hosted software for bookings, quotes, invoicing, landing pages and email. Businesses on the platform are independent of Aqeris; their services are contracted between them and their customers, under their own published terms.
Your responsibilities
Keep your credentials secure, publish accurate prices and policies, and use the platform lawfully. You are responsible for content on your landing pages.
Your content and the rights in it
All text, images, logos, service descriptions and other material you upload or publish through Aqeris ("Your Content") is supplied by you. You retain ownership of Your Content and grant Aqeris only a limited, non-exclusive licence to store, host, reproduce and display it for the purpose of operating the platform and showing your pages to your customers. You warrant that you own or are licensed to use Your Content and that it does not infringe any third party's intellectual property or other rights.
Our role as a host
In relation to Your Content, Aqeris acts as a neutral host and storage provider. We do not create, select, monitor, endorse or edit Your Content, and you do not act under our authority or control when you publish it. We do not pre-screen content for intellectual property infringement. Where we host content supplied by a user, we rely on the protections available to hosting providers under applicable law, including Regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002.
Reporting infringement (notice and takedown)
If you believe content hosted on Aqeris infringes your copyright or other intellectual property rights, tell us using the notice form on our Copyright & IP page. On receiving a notice that gives us sufficient knowledge of an infringement, we act expeditiously to remove or disable access to the content in question, and we may notify or suspend the account responsible.
Indemnity for your content
You agree to indemnify Aqeris against claims, losses and reasonable costs arising from Your Content or from your breach of these terms, including third-party intellectual property claims relating to material you supplied.
Billing
Plan fees are billed in advance and are non-refundable except where required by law. We will give at least 30 days notice of price changes.
Liability
The service is provided with reasonable skill and care. To the extent permitted by law our aggregate liability is limited to fees paid in the preceding 12 months.
